Classify the payment before paying
An overseas invoice does not, by itself, determine the Indian tax treatment. First identify what the contract supplies, where the work is performed, who owns any intellectual property, and which entity receives the money. Keep the contract and invoice together so the description used for accounting, banking, and tax review is consistent.
Build a treaty record when relevant
If a party intends to rely on a double taxation agreement, review the treaty that applies to that country and payment. The Income Tax Department explains the role of a tax residency certificate and Form 10F in certain treaty claims. Their presence is part of the record, not a substitute for checking the actual facts and applicable provisions.
Commercial: Contract, scope, acceptance evidence, and invoice.
Counterparty: Legal name, address, tax identifiers, and relevant residency material.
